Arrested man claimed he was not drinking, had beer can between legs

A man pulled over for speeding was arrested for driving under the influence on Monday night. 

A Chickasha Police Officer pulled over Jimmy Neely after the officer's radar picked up Neely's vehicle moving 48 mph in a 40 mph speed zone. 

The officer detected an odor of alcohol on Neely's person, red glassy eyes and slurred speech. The officer also observed an unopened can of beer between Neely's legs. When the officer asked Neely if he had been drinking, Neely said no. Neely was unable to explain the can of beer between his legs or why he smelled of alcohol. 

When the officer asked Neely to step out of the car, Neely was unsteady on his feet and lost his balance. After being given a standard field sobriety test, Neely was arrested for driving under the influence. He was transported to Station One where he was given a breath test. His results showed a 0.20 BAC.
